They are referred to in these terms as the “Sites” and the “Services”. The Services include the provision of information and materials, and tools to enable you to share information and materials, network and communicate with us and other users. The term “content” is used in these terms to refer to such information, materials and tools.

The terms apply between you, the user of our Sites and Services, and Caribbeans Connects, a company registered in England and Wales with company number 4749221 (also referred to as “we” or “us”).

If you use any Site or Service as an employee or representative of another legal entity, you accept these terms on behalf of yourself and the legal entity, and confirm that you have authority to do so.

• a candidate (including actors, Musicians, presenters and models)
• an employer (including casting professionals and filmmakers, Crew)
• a service provider (including photographers and Videography providers)
• an agent for candidates
• an advertiser of services or products

Caribbeans Connects – Our Services serves as a digital platform facilitating direct interactions between Talent and Casting Professionals in the entertainment industry. Distinct from an agency, Caribbeans Connects – Our Services refrains from acting as a representative for talent or advertisers.

The platform manages a website providing a service for advertisers, encompassing television production companies, advertising agencies, theaters, event promotion companies, and others in the entertainment sector, to publish classified advertisements. Advertisers have the option to place these ads, while individuals such as models, actors, dancers, photographers, and musicians may choose to apply. Upon application, applicant details are either transmitted to the advertiser or displayed with additional application instructions. This service, or a more limited version, is also accessible through the Caribbeans Connects – Our Services App.

Members of Caribbeans Connects – Our Services, referred to as “Members,” can include information on their profiles about close contacts (e.g., family members) interested in participating in auditions and jobs offered by advertisers and talent and casting professionals. Advertisements may be linked to a microsite created and hosted by Caribbeans Connects – Our Services at its discretion. Subscribers to Caribbeans Connects – Our Services Membership will be showcased in the Talent Directory, facilitating communication with other members and providing access to additional features and tools.

By default, a Member’s profile is public, accessible to any internet user visiting Caribbeans Connects – Our Services, including photos and showreels, and discoverable through search engines like Google. Members also have the option to purchase credits on the website to facilitate communication with other Members.

Caribbeans Connects – Our Services explicitly disclaims responsibility for the content and provides no warranty concerning the accuracy of advertisements. Members are encouraged to exercise their own judgment when deciding to apply for roles advertised on the platform. The platform is designed solely for the purpose of listing casting, auditions, and, at its discretion, general jobs with third-party advertisers. Caribbeans Connects – Our Services shall not be held liable for the actions of any advertiser or the outcome of any role or job featured on the platform.

Furthermore, Caribbeans Connects – Our Services disclaims responsibility for the content and accuracy of Members’ personal information or close contacts’ information. Advertisers are urged to exercise their own judgment when contacting, casting, or auditioning Members, and Caribbeans Connects – Our Services shall not be liable for the actions of any Member or close contact.

Submission of a listing for placement on Caribbeans Connects – Our Services implies consent to the use of the individual’s name, website, email, logo, and listing information in marketing and promotional activities conducted by Caribbeans Connects – Our Services.

The offerings of Caribbeans Connects – Our Services are confined to providing advertisers access to information about applicants seeking work in the entertainment business and offering access to information about advertisers to such applicants. This service is the exclusive work-finding service provided by Caribbeans Connects – Our Services, and the platform is not intricately connected to advertisers or applicants beyond the stipulations outlined in the Terms of Use.

Users acknowledge that the decision to offer auditions or jobs resides with the advertisers using Caribbeans Connects – Our Services, and job availability is subject to industry dynamics. Caribbeans Connects – Our Services does not provide a guarantee that applicants will secure auditions or jobs or that advertisers will discover suitable talent through the platform.

Users are responsible for ensuring the acceptability of any audition or job offered by employers to them or their close contacts. Caribbeans Connects – Our Services cannot offer advice regarding the nature, duration, terms, or payment for any job.

Members explicitly acknowledge that no term in the Terms of Use or any other matter arising from the use of Caribbeans Connects – Our Services shall establish a relationship of employment, principal and agent, joint venture, legal partnership, or any other legal relationship, except that of a user and provider of services.

Site Access:

Some information on the Sites is accessible to all visitors without registration.

Registration and Profiles:

To access specific Services, registration and profile setup are required. Refer to Part B for terms related to different profiles.

Subscriptions:

Additional subscriptions are necessary for certain Services, and payment may be required (see clause 7 below). Details on subscribing, payments, and additional terms are available on the relevant Site.

Processing Time:

We aim to process registration and subscription applications within two working days, but access to the Site or Service is not guaranteed within a specific timeframe.

Subscription Commencement:

The subscription period begins upon receipt of payment. For free subscription periods, access is granted when we approve it. We reserve the right to deny access to our Sites or Services at our discretion. Please select the appropriate membership -  1 month £ 2.99/ 6 month £ 14.99/ 1 year £ 27.99.

Eligibility:

– Access to specific Sites and Services is subject to meeting specified criteria, detailed on the relevant Sites.
– Users under 18 years of age are not permitted to register or subscribe. However, a parent, guardian, or agent may use the Sites and Services on behalf of a candidate under 18, ensuring compliance with the terms.

Responsibility for Minors:

Caribbeans Connects is intended for individuals aged 18 or over. Legal guardians can register and operate a profile for a minor, acknowledging the potential inappropriate content and agreeing to supervise the minor’s profile activity.

– Individuals under 18 cannot operate their own registered profile on Caribbeans Connects. If registered on behalf of a minor, compliance with Terms of Use is required, and any breach by the minor is considered a breach by the guardian.

Membership Restrictions:

– Usage of Caribbeans Connects is prohibited if you have a history of serious, violent, or sexually related criminal offenses, previous bans from our Services, association with a banned user, involvement in a competing entity, or association with the adult industry.
– Caribbeans Connects reserves the right to refuse or cancel memberships without explanation.

Access to Content and Services:

• Responsibility for Access:
  – You are responsible for arranging and paying for your access to our Sites and Services, including internet connections, computer equipment, and software.
  – We are not accountable for internet or network availability, and we do not assume responsibility for malfunctions, errors, or damages related to your use of the Sites or Services.
• Security and Login Details:
  – Keep your passwords confidential; any use of the Sites and Service using your login details is your responsibility. – Unauthorized use of your login details is your responsibility, except by our Site administrators.
• Intended Use of Sites and Services:
  – Our Services and content are for information and convenience, not to be solely relied upon for important actions.
  – We do not routinely check all user-provided content and cannot guarantee its accuracy or lawfulness.
• User Responsibilities:
  – Confirm information independently, back up your content, and ensure secure and prompt communications. – Any dealings with other users or third parties, including auditions, roles, jobs, payments, and services, are your responsibility.
• Third-Party Links and Services:
  – Our Sites may contain links to third-party websites; we do not control or take responsibility for their content. – Information transmission via third-party services is not our responsibility.
• Liability Agreement:
  – You agree not to hold us liable for losses incurred due to reliance on content from other users or third parties. – Reporting inappropriate content or negative experiences is encouraged; we may investigate and take appropriate steps.
• Intellectual Property:
  – Contents of our Sites and Services are protected by intellectual property rights.- You are granted a non-exclusive, revocable license for personal use, but commercial exploitation is prohibited.
• Quality of Services:
  – The quality of services depends on providing accurate, complete, and lawful content. – You agree to provide accurate information in your registration and profiles and obtain necessary rights for the use of your content.
• Use of Provided Content:
  – We may use the content you provide for operating and maintaining the Site and Services.- You grant us a perpetual and irrevocable worldwide license to use your content for these purposes.
• Cookies:
  – You agree that we may use cookies as specified in our privacy policy to track your actions on the site.

Note: While we encourage user compliance with these terms, we are not responsible for the use or misuse of your content by other users or third parties. We will, however, reasonably cooperate in enforcing our contractual terms against users who infringe your rights at your expense.

Caribbeans Connects Responsibilities:

Access Arrangements:
– You are responsible for arranging and paying for access to our Sites and Services, including internet connections, computer equipment, and software. We are not responsible for internet or network availability, nor for malfunctions, errors, or damages related to your use of the Sites or Services.

Password Confidentiality:
– Keep your passwords confidential; any use of Caribbeans Connects using your login details is your responsibility, excluding our Site administrators.

Services and Content Purpose:
– Caribbeans Connects Services and content are for your information and convenience, not intended for sole reliance in taking or refraining from actions. While we aim for user agreement with these terms, we do not routinely check all content from users and third parties, and cannot guarantee its accuracy or lawfulness.

Cautionary Points:
– Do not rely on any content or Service for availability, accuracy, or completeness.
– Avoid relying on our Services for storage, maintenance of your content, or for crucial communications. Inclusion of information, advertisements, or content about other users or third-party services/products does not constitute our recommendation or endorsement.

User’s Due Diligence:
– Take steps to confirm information, back up your content, and ensure secure and timely communications. Any communications, contracts, or arrangements with other users or third parties are your responsibility, including auditions, roles, jobs, payment, and service delivery.

Third-Party Links and Services:
– Our Sites may contain links to third-party websites; we do not control or take responsibility for their availability, accuracy, or content. Transmission of information via third-party services like Twitter or Facebook is not our responsibility.

Non-Liability Agreement:
– You agree not to hold Caribbeans Connects liable for loss or damage resulting from reliance on content from other users or third parties, or from communications, contracts, or dealings with them.

Caribbeans Connects Terms of Use:

• Compliance with Applicable Laws:
  – Users must comply with all applicable laws when using Caribbeans Connects Sites and Services.
• Unlawful or Unauthorised Use:
  – Users are prohibited from any unlawful or unauthorized use of Caribbeans Connects’ computers, networks, communications systems, or equipment.
  – Prohibited actions include attempting unauthorized access, introducing malware, reverse engineering software, stalking, harassment, sending offensive communications, contacting users for unrelated reasons, restricting others’ usage, and misrepresentation.
• Linking to or from Our Sites:
  – Users may include fair and lawful links to Caribbeans Connects Sites on their websites or profiles, ensuring no damage to Caribbeans Connects’ reputation.
• Subscription Charges:
  – Charges for certain subscription services are applicable. Details can be found on the Sites or provided upon request.
  – Payments must be made in the specified currency using credit or debit cards associated with your login details.
  – Users are responsible for taxes, and interest may be charged on overdue payments.
• Monitoring Your Use:
  – Caribbeans Connects may monitor, access, and disclose details of user activity for compliance, quality control, administration, investigations, legal obligations, and rights protection.
• Consequences of Breach:
  – Breaching terms may lead to immediate suspension of access or content removal without notice.
  – Caribbeans Connects reserves the right to terminate access and services, with no compensation during suspension unless outlined in the refund policy.
  – Users indemnify Caribbeans Connects against claims arising from breaches.
• Termination Rights:
  – Users can terminate use and request profile removal with a two-week notice.
  – Caribbeans Connects may withdraw services or terminate access at its discretion, providing reasonable notice unless due to material breach.
• Consequences of Termination:
  – Refunds may be applicable for advance payments post-termination, subject to the refund policy.
  – Profiles may be removed, login details disabled, and personal details retained for record-keeping.
  – Certain terms, including exclusions and limitations, survive termination.
• Changes to Sites, Services, and Terms:
  – Caribbeans Connects may make temporary or permanent changes to the Sites, Services, or terms at its discretion.
  – Reasonable efforts will be made to notify users of material changes.
  – Users agree to changes by continuing to use the Sites and Services.

Periods of Unavailability:

The Sites and Services may be occasionally unavailable for maintenance. Caribbeans Connects is not liable for any loss or damage during such periods.

By using Caribbeans Connects, you agree to abide by these terms.

Caribbeans Connects – Limitations on Liability.

• Exclusion of Conditions, Warranties, and Representations:
  – All conditions, warranties, and representations implied by statute or common law, not expressly set out in these terms, are excluded to the maximum extent permitted by law.
• **Liability Limitations:**
  – Caribbeans Connects and its representatives shall not be liable for:
  (a) any direct loss or damage; nor
  (b) any consequential or indirect loss or damage,
  arising from the use or inability to use Caribbeans Connects’ Site or Services, including any content. This includes, but is not limited to, loss of business, job, opportunities, customers, revenue, profit, contracts, data, software, reputation, or wasted time, whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.
• Total Liability Cap:
  – Caribbeans Connects’ total liability to you in any 12-month period, arising from your use of the Site and/or Services, shall be limited to the amounts paid by you for the relevant Service during that period.
• Governing Laws and Jurisdiction:
  – These terms are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction over disputes arising from them.
• Force Majeure:
  – Caribbeans Connects shall not be responsible for any failure or delay in performance of the Services or obligations under these terms due to causes beyond its reasonable control.
• Additional Points:
  – Headings in these terms are for ease of reference.
  – The term “including” in these terms and the privacy notice means “including but not limited to.”
• No Agency Relationship:
  – The provision of Services does not create an agency relationship between you and Caribbeans Connects. Neither party has the authority to bind the other.
• Enforceability:
  – If any provision of these terms is found invalid, unenforceable, or illegal, other provisions shall remain in force. The invalid provision shall be modified to ensure validity, enforceability, and legality while maintaining its commercial intent.
• Entire Agreement:
  – These terms, including any additional provisions incorporated by reference, constitute the entire agreement between you and Caribbeans Connects. They supersede all prior agreements, negotiations, and discussions relating to the subject matter.

Caribbeans Connects – Job Opportunities and Paid Services:

• No Guarantee of Jobs:
  – Caribbeans Connects does not guarantee job offers, as the decision to offer jobs or appointments rests with casting agents and other employers. The availability of jobs is influenced by the overall state of the industry. We cannot ensure you work or that employers viewing your profile will contact you for auditions or interviews.
• Responsibility for Job Acceptance:
  – It is your responsibility to ensure any job or appointment offered by employers is acceptable to you. Caribbeans Connects cannot verify or provide assurances regarding the nature, duration, or payment for any such job or appointment.
• Paid Services:
  – If you register a profile, our Premium service is available through monthly instalments or an annual fee. You may cancel your subscription at any time.
  – If cancelled within 14 days of upgrading (without active service use), a full refund is applicable for annual fees.
  – If actively used within the 14-day period, refunds vary based on payment terms (monthly or annual).
• Responsibilities of Employers:
  – Casting professionals and employers must ensure that job postings and related content comply with applicable laws, covering minimum payments, non-discrimination, tax, and employment. Employers are responsible for candidate licenses and necessary DBS checks.
• Advertising on Caribbeans Connects:
  – To advertise, contact info@Caribbeansconnects.com or use the “contact us now” page, applying separately with a fee. Details of advertising application and display are on the Sites.
  – Advertisers must ensure compliance with legal requirements, advertising standards, and codes of practice. Advertisements conflicting with Caribbeans Connects’ services may be refused or removed.
• Submission of Material and Privacy:
  – Material submitted through the Website and/or the App may be utilized for marketing purposes indefinitely, subject to the Privacy Policy.
  – Caribbeans Connects reserves the right to reproduce, modify, distribute, and display submitted information worldwide.
  – Adding details of close contacts to your profile requires express consent from them for lawful processing, including making the information available to advertisers, in line with these Terms of Use.
